25-27 квітня 2024 року у Варшаві відбувся щорічний З’їзд Європейської асоціації суддів (EAJ).
У З’їзді приймали участь делегати від ВГО «Асоціація суддів України», а саме Віцепрезидент Асоціації суддів України Олена Євтушенко та суддя Подільського районного суду міста Києва Марина Шаховніна.
25 квітня 2024 року у Сенаті Польщі була проведена конференція «Марш 1000 мантій за кращу Європу». Конференцію організовано суддями Польщі за підтримки Сенату Польші. Метою конференції було обговорення масштабної акції «Марш 1000 мантій», яка відбулась 11 січня 2020 році.
Судді, адвокати та інші представники юридичної спільноти вийшли на вулиці, щоб висловити свою підтримку принципу незалежності судової влади. До них приєдналися колеги з інших країн Європи (22 європейські країни), що продемонструвало міжнародну солідарність та підтримку. Це сильний приклад того, як професійна спільнота може об’єднатися в захисті своїх цінностей та принципів, незважаючи на політичний тиск і загрози. Ця подія показала важливість солідарності та рішучості в боротьбі за справедливість і верховенство права, надихнула мене на активну позицію у захисті незалежності суддів у своїй країні. Ця акція стала важливим символом боротьби за незалежність судової влади в Польщі і нагадуванням про важливість дотримання демократичних принципів у всьому світі. Спеціальний доповідач ООН з питань незалежності судової влади підтримав звернення Президентського комітету Міжнародної асоціації суддів назвати 11 січня «Міжнародним днем незалежності суддів» на згадку про «Марш 1000 мантій».
26 квітня 2024 року відбувся З’їзд Європейської асоціації суддів. У заході взяли участь Президент IAJ пан Дуро Сесса, Перший віце-президент IAJ пан Вальтер Бароне, Президент ЄАС Мікаель Шьоберг, віце-президенти ЄАС та члени Ради ЄАС пані Сабіне Матейка та пан Роланд Кемпфле, Почесний президент, пан Хосе Мануель Ігреха Матос, Герхард Райсснер, Майя Тратнік, Гюнтер Воратч, а також делегати 38 асоціацій-членів Європейської асоціації суддів. У З’їзді також взяли участь делегати від Всеукраїнської громадської організації «Асоціація суддів України».
Віцепрезидент Кемпфле згадав про роботу Європейської мережі підготовки суддів (EJTN), яка запропонувала прийняти пропозиції від суддів щодо своїх програм.
Віцепрезидент Матейка оголосив, що форум правничих професій відбудеться у гібридному форматі в листопаді цього року на тему «Покращення здійснення правосуддя за допомогою інновацій». Пані Матейка додала, що її також було призначено членом групи SATURN в рамках CEPEJ, яка зараз працює над новим інструментом зважування справ, а також над інструментом з управління судами та потенційним впливом штучного інтелекту.
Президент IAJ пан Сесса зазначив, що КРЄС також глибоко залучена до вивчення ситуації в судовій системі Польщі.
Цього року Комітет займається питанням дисциплінарних проваджень щодо суддів, включаючи люстрацію. Пан Сесса закликав делегатів контактувати зі своїми національними представниками в КРЄС та надати свої пропозиції для підготовки висновку, який матиме величезне значення в Європі.
Асамблея розглянула поточні проблеми судової влади в Європі та прийняла наступні резолюції:
– Угорщина (щодо належній оплаті праці суддів як гарантування незалежності суддів);
– Італія (щодо залучення суддівської спільноти до обговорення привнесення змін до Конституції, що регулює діяльність судової влади);
– Словенія (щодо виконання рішення Конституційного суду про належну заробітну плату (винагороду) суддів);
– Іспанія (щодо невтручання парламентом та політиками у діяльність судової влади).
Також президент Асоціації суддів Турції Ігрея Матос та пан Мурат Дурмаз представили дві ініціативи, спрямовані на забезпечення того, щоб колишній президент асоціації суддів Турції – пан Мурат Арслан, міг користуватися справедливою процедурою для прийняття рішення про його умовно-дострокове звільнення, яке до цього часу було відхилено без жодних підстав. Першою ініціативою стало прийняття заяви, в якій ЄАС в цілому закликала турецьку владу звільнити пана Мурата Арслана. Асамблея одноголосно схвалила цю заяву. Другою ініціативою була пропозиція, щоб кожен член ЄАС звернувся з листом до міністра юстиції Туреччини з проханням втрутитися в ситуацію з паном Арсланом і забезпечити пану Арслану справедливий допит та прийняття рішення щодо його умовного звільнення.
На З’їзді обговорювались питання привабливості суддівської кар’єри, яка значною мірою залежить від належної суддівської винагороди, та незалежність судової гілки влади. Незалежність судової влади є основою для ефективного та справедливого правосуддя, яке сприяє зміцненню довіри до судової системи та держави в цілому.

Ми зіткнулися з агресором, для якого наше спільне європейське прагнення до миру й правил нічого не важить і який хоче Європі такого, з чим не погодиться жодна вільна нація, жоден сумлінний лідер.
Ми з вами єдині в тому, що Європа та всі інші частини землі не мають бути місцем, де амбіції тиранів ламають життя народів.
В умовах в яких знаходиться Україна, для нас кожен день є випробовуванням і у житті і у роботі, але ми неодмінно усе здолаємо і впораємося із усіма труднощами!
Незважаючи на тимчасове захоплення агресором частини території України, постійні обстріли та ракетні удари по всій Україні, національна судова система продовжує повноцінно функціонувати в умовах воєнного стану.
Внаслідок окупації Херсонщини приміщення Херсонського апеляційного суду та місцевих судів зазнали значних руйнувань та пошкоджень — як зовнішніх, так і внутрішніх, а саме пошкоджені системи опалення, вікна, відсутній інтернет-зв’язок. Техніка і меблі за час тимчасової окупації Херсонської області та ведення бойових дій були викрадені або пошкоджені окупантами, що виключає можливість їх подальшої експлуатації.
11 травня 2023 року президент Всеукраїнської громадської організації «Асоціація суддів України» В. Коротун побував з робочим візитом у Херсонському апеляційному суді. У рамках робочої зустрічі він поспілкувався з головою Херсонського апеляційного суду О. Коровайко та керівником апарату. Предметом обговорення стали проблемні питання, що виникають у ході підготовки до відновлення роботи цього суду, питання матеріально-технічного та організаційного забезпечення, а також шляхи їх вирішення та створення належних умов для надання судових послуг населенню деокупованих громад.
Під час зустрічі президентом Всеукраїнської громадської організації «Асоціація суддів України» В. Коротуном було передано ноутбуки, принтери та папір, які було придбано за рахунок наданої допомоги Асоціації суддів Чехії та Асоціації суддів Грузії, що безумовно вплинуло на скоріше відновлення роботи суддів.
Окрема вдячність Асоціації суддів Чехії та Асоціації суддів Грузії, які надали матеріальну підтримку українським суддям.
01-03 червня 2023 року у місті Афіни (Грецька Республіка) відбувся з’їзд Європейської асоціації суддів. Всеукраїнська громадська організація «Асоціація суддів України» делегувала своїх членів для участі у з’їзді.
У роботі з’їзду прийняли участь: суддя Конституційного Суду України Віктор Городовенко та суддя Вищого спеціалізованого суду України з розгляду цивільних та кримінальних справ (у відставці) Олена Євтушенко.
На з’їзді Віктор Городовенко та Олена Євтушенко висловили вдячність асоціаціям суддів Європейських судів за підтримку України та українських суддів у такі нелегкі часи.
У своїй доповіді Віктор Городовенко звернув увагу, що в такі нелегкі часи для України головним завданням українських суддів є повноцінне функціонування в умовах воєнного стану та підтримка суддями Європейських країн.
Олена Євтушенко презентувала відеоогляд пошкоджених судів України та розповіла про стан здійснення правосуддя в умовах війни у 2023 році.
Основна тема, яка обговорювалась на з’їзді – це незалежність правосуддя, захист, свобода та небезпека верховенства права в Європі. По країнам Франції, Хорватії, Республіки Вірменії, Болгарії та Литви було прийнято резолюції.
16 – 21 вересня 2023 року відбувся 65-й щорічний з’їзд Міжнародної Асоціації суддів (Тайвань). Участь у з’їзді взяла член Всеукраїнської громадської організації «Асоціація суддів України», суддя Вищого спеціалізованого суду України з розгляду цивільних та кримінальних справ (у відставці) Олена Євтушенко.
Програма 65-ого Міжнародного з’їзду асоціації суддів світу включала заходи, засідання та семінари на теми, зв’язані з правосуддям та проблемами, які стоять перед судовими установами в усьому світі.
Зокрема, на засіданні 17 вересня 2023 року Європейська Асоціація суддів прийняла заяву щодо ймовірного судового переслідування литовських суддів російською владою.
18 вересня 2023 року офіційно розпочалася 65 -та щорічна зустріч Міжнародної Асоціації суддів. У церемонії відкриття взяли участь президент Тайваню пані Ін-вень Цай; президент АС Тайваню Цзун-Лі Хсу; засновник TSMSC Морріс Чанг.
Під час першої сесії Центральної Ради до асоціації було прийнято нового члена Буркіна-Фасо.
19 вересня було вручено три нагороди за незалежність судової системи відповідно: президенту Асоціації суддів Тунісу, судді Анас Хмеді та судді з Афганістану Азар Сарем та національній судовій раді Угорщини, зібраної президентом паном Томашем Матусіком.
Під час тайбейської зустрічі Центральної ради Міжнародної Асоціації суддів (65-і загальні збори Центральної ради Міжнародної Асоціації суддів) пан Дуро Сесса, колишній перший віце-президент Міжнародної Асоціації суддів і президент Європейської Асоціації суддів, був обраний шляхом акламації новим президентом Міжнародної Асоціації суддів.
Також минулого Президента, пана Хосе Ігреха Матоса, якого шляхом аккламації було призначено Почесним Президентом Міжнародної Асоціації суддів.
Членами нового Президентського комітету стали: пан Уолтер Бароне (перший віце-президент), пані Еллісон Дункан, пані Марселл Куассі, пан Мікаель Сьоберг, пані Сабіна Матейка та пан Роланд Кемпфле .
Пан Джакомо Оберто, нинішній Генеральний секретар Міжнародної Асоціації суддів з 2012 року, був затверджений шляхом акламації на цій посаді разом із трьома його заступниками, паном Д’Агостіно, паном Гарджіуло та паном Аскеттіно.
21 вересня пан Мікель Сьоберг був обраний новим президентом Європейської Асоціації суддів. Пані Сабіна Матейка та пан Роланд Кемпфле були обрані віце-президентами Європейської Асоціації суддів.
По країнам Туніс і Вірменія було прийнято важливі резолюції. У цей же день Європейська група ухвалила резолюцію щодо Молдови.

I express my sincere respect and address you with the following.
According to the Statute of the Association of Judges of Ukraine, the Association of Judges protects judges and retired judges, represents their interests before international institutions and public authorities of Ukraine.
On August 8, 2023, judges of the High Administrative Court of Ukraine, the High Commercial Court of Ukraine and the High Specialized Court of Ukraine for Civil and Criminal Cases (further, the HSCU, the HECU, the HACU), representing more than 50 judges of these courts, addressed the Association of Judges of Ukraine with the statement that certain provisions of Draft Law # 5456-Д do not meet international standards of judicial independence, as it does not guarantee that judges of cassation courts will retain their status, and asked to help protect the interests of judges, as well as the possibility of addressing this issue to the international community.
In this regard, the Association of Judges of Ukraine considers it necessary to address the Advisory Council of European Judges.
The judicial system of Ukraine has been reformed several times within the last few years. As a result of the Constitutional reform of 2016, introduction of the three-branch judicial system (local courts; courts of appeal; the Supreme Court) has become one of the major Constitutional changes. According to the law, the higher specialized courts may operate, and the administrative courts are established.
Currently, there is no legal mechanism governing termination of the HSCU, the HECU, the HACU as the legal entities consistently with the principle of legal certainty established by the Constitution of Ukraine. There is still neither the Decree of the President of Ukraine nor the relevant law on termination (liquidation, reorganization, renaming etc.) of the higher specialized courts.
Uncertainty, vagueness and ambiguity of the legal regulations governing termination of the HSCU, the HECU, the HACU, including unlimited interpretation in the legal practice, entail arbitrariness, breach of the constitutional guarantees, violation of international standards and practices in the area of transfer of the specified court judges appointed for an unlimited term by virtue of the Constitution effective upon their appointment. And now, it has been six years since the 45 judges of the HSCU, the HECU, the HACU are prohibited from their professional activity while they are still the authorized judges, without being officially dismissed because they are not holding any offices in the specified court.
Unforeseen suspension of duties of the HSCU, the HECU, the HACU judges as a result of the court reformation contradicts the non-changeability principle and makes it impossible for a judge to work until the age of 65.
The national legislation governing status of the judges prescribes no transfer of a judge to the court of the same level and violates the international standards, including the recommendations of the Committee of Ministers in the Council of Europe, the Consultative Council of European Judges, the conclusions and standards of the Venice Commission, the Consultative Council of European Judges bureau, as well as restricts the effective constitutional guarantees of judicial authority independence, which may consequently jeopardize Sections 6 and 8 of the European Convention on Human Rights and Fundamental Freedoms.
To execute the Decision of the Constitutional Court of Ukraine dated 18.02.2020 recognizing the relevant legislative measures as being non-constitutional in relation to the Supreme Court of Ukraine due to violation of the non-changeability principle, the parliament tries to correct the errors again, and on 16.03.2023, the Bill # 5456-Д is issued. On 20.03.2023, the specified Bill is reviewed by Verkhovna Rada of Ukraine in the first reading.
However, the Bill # 5456-Д does not guarantee that the cassation court judges will retain their status.

In particular, the Bill includes the provisions detailed below:
– if the court system changes, the HSCU, the HECU, the HACU judges may be transferred to the lower courts (courts of appeal or local courts) without their consent (clause 2, paragraph 14-1), and may not be transferred to the higher specialized court without competition;
– the HSCU, the HECU, the HACU judges transferred to other courts and those intending to resign shall be equal to the judges of the higher specialized courts in terms of their status and social welfare services (clause 6, paragraph 14-1).
Under Section 125 of the Constitution of Ukraine as amended by the Law of Ukraine # 1401 of 02.06.2016, the specialized courts for certain categories of cases,
namely, the High court on intellectual property and the High anti-corruption court of Ukraine, have been established as part of the reformation and are operating as the courts of the first instance and the courts of appeal.
In the previous version of Section 125 of the Constitution of Ukraine, the higher specialized courts were the higher judicial authorities in the relevant area in the judicial system and exercised the powers of the cassation courts.

Hence, identification of these courts by name does not determine their instance and specialization constituting the basis of the judicial system (Part 1 of Section 17, Part 3 of Section 19 of the Law of Ukraine “On the judicial system and the status of the judges”).

Adoption of the Bill may undermine stability of the judicial system and make it impossible to implement the principles aimed at establishment of the non­ changeability standards and, accordingly, ensure independence of the judges.
The suggested Bill does not provide any guarantees detailed in Conclusion of CCJE-BU (2020)3 of 09.12.2020 about the reformation of Slovakia judicial system (upon request of the Member of Consultative Council of European Judges from Slovakia), in particular, upon changes of the judicial system, the judge may not be legitimately transferred to the court of the same instance; long-term unexcused non­ transfer infringes on the right of the judge to enjoy private and family life; the government does not cover the costs associated with the transfer.
The HSCU, the HECU, the HACU judges are the only ones who still receive the financial payments based on the Law # 2453 of 07.07.2010 that has been voided and become unenforceable in relation to other Ukrainian judges of any level affected by professional discrimination.
In view of the above,
we kindly ask you to determine at your earliest convenience whether the Bill # 5456-Д is in line with the European standards and provide the Conclusion exhibiting the legal analysis of the changes to be made to the Law of Ukraine “On the judicial system and the status of the judges.”

THE LAW OF UKRAINE
On introduction of changes to Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges” in connection with Resolution of the Constitutional Court of Ukraine # 2-p/2020 of February 18, 2020 on permanent administration of justice by the highest court in the judicial system of Ukraine

The Verkhovna Rada of Ukraine hereby decrees:

1. To make changes to Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges” (Information of the Verkhovna Rada of Ukraine 2016, # 31, page 545 as amended) as follows:
1) in paragraph 2, replace “in paragraphs 7, 23, 25, 36″ words and digits with “in paragraph 7″ the words and digits;
2) amend subparagraph 1 of paragraph 4 as follows:

“1) the Supreme Court of Ukraine, being the public authority, shall be renamed as the Supreme Court and continue operating as the highest court in the judicial system of Ukraine”;
3) include paragraphs 41 and 42 as follows:

“41. The judges of the Supreme Court of Ukraine appointed before the effective date of the Law of Ukraine “On introduction of changes to the Constitution of Ukraine (in the part of justice)”, shall continue exercising their duties as the judges of the Supreme Court in the relevant expert area, until they are removed from office or their authority is terminated on the grounds prescribed by the Constitution of Ukraine.

42. The officers of the apparatus of the Supreme Court of Ukraine whose authority is still in effect, shall be transferred, upon their personal request without the mandatory competition, to the equivalent positions in the apparatus of the Supreme Court following the procedure prescribed by the law”;

4) amend paragraph 5 as follows:

“5. The Supreme Court acts on the material and technical basis of the Supreme Court of Ukraine, the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine”;

5) exclude “the Supreme Court of Ukraine” words in paragraph 7;

6) amend paragraph 71 as follows:

“71. The judges specified in paragraph 41 of the said Part (except those who have proved to be eligible for their positions before effective date of the Law of Ukraine “On introduction of changes to Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges” in connection with Resolution of the Constitutional Court of Ukraine # 2-p/2020 of February 18, 2020 on permanent administration of justice by the highest court in the judicial system of Ukraine”), shall be assessed by the High Qualifications Commission of Judges of

Ukraine in order to determine their eligibility for the relevant positions based on the criteria of competence, professional ethics and fairness following the procedure prescribed by the specified Law and with due regard to the particulars detailed in the specified paragraph.
The qualification of the judges shall be assessed by decision of the High Qualifications Commission of Judges of Ukraine on qualification assessment. The qualification assessment by competence criteria is only available in the form of an interview.

The Public Integrity Council helps the High Qualifications Commission of Judges of Ukraine to determine whether the judges meet the professional ethics and fairness requirements”;
7) exclude “the Supreme Court of Ukraine” words in paragraph 14;

8) amend paragraphs 141 – 142 as follows:

“141. A judge of the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine may be transferred to the court of appeal or a local court following the procedure prescribed by Sections 53 and 82 of the specified Law, without competition and with due regard to the particulars detailed in the specified paragraph.

The judge as mentioned above shall be transferred upon review of his or her application by the Supreme Council of Justice within 30 days following the effective date of the Law of Ukraine “On introduction of changes to Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges” in connection with Resolution of the Constitutional Court of Ukraine # 2-p/2020 of February 18, 2020 on permanent administration of justice by the highest court in the judicial system of Ukraine”, regardless of the vacancies available in the court.

If the judge of the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine submits no request for transfer to the certain court by his or her choice, the Supreme Council of Justice shall transfer such judge as abovementioned to any other court of appeal that offers a vacancy, without consent of the judge.

The Supreme Council of Justice makes decisions regarding the transfers without recommendations of the High Qualifications Commission of Judges of Ukraine.

The judges mentioned in this paragraph (except the ones who have proved to be eligible for their positions before effective date of the Law of Ukraine “On introduction of changes to Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges” in connection with Resolution of the Constitutional Court of Ukraine # 2-p/2020 of February 18, 2020 on permanent administration of justice by the highest court in the judicial system of Ukraine”), shall be assessed for eligibility for the relevant positions based on the criteria of competence, professional ethics and fairness following the procedure prescribed by the specified Law.

The judges of the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine transferred to other courts, as well as the resigning judges shall be equal to the judges of the higher specialized courts in terms of their status and social welfare services.

“142. Upon resignation, the judges of the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine,

regardless of their positions at the time of resignation, shall be granted the lifelong monthly financial support in the amounts and following the procedure prescribed by the specified Law, considering the amount of the judges’ remuneration estimated based on the basic salary of the judges in the higher specialized courts.

The judges of the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine granted the lifelong monthly financial support under the Law of Ukraine “On the judicial system and the status of the judges” (Information of the Verkhovna Rada of Ukraine 2010, # 41-45, page 529 as amended) are eligible for the lifelong monthly financial support payable in the amount and following the procedure prescribed by Part three of Section 142 of the specified Law, considering the amount of the judge s’ remuneration estimated based on the basic salary of the judges in the higher specialized courts”;

9) in clause one of paragraph 20, replace “determined by the specified Law” with “prescribed by the Law”;
10) in clause one of paragraph 24, exclude “except as mentioned in provision 23 of the same Part” words and digits;

11) remove provision 25;

12) exclude “the Supreme Court of Ukraine” words in subparagraph one of paragraph 45.

2. The Law shall take effect on the day following the publication day.

3. The provisions of this Law shall extend to the legal relations arising in connection with renaming of the Supreme Court of Ukraine as the Supreme Court, as well as liquidation of the Higher specialized court of Ukraine for civil and criminal cases, the Higher economic court of Ukraine, the Higher administrative court of Ukraine.
4. To exercise the provisions of paragraph 41 of Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges”, the judges of the Supreme Court of Ukraine elected before the effective date of the Law of Ukraine “On amendment of the Constitution of Ukraine (in the area of justice)” and included into the staff of the Supreme Court of Ukraine on the effective date of the specified Law, shall, within 20 days following the effective date of the specified Law, submit their requests for enrollment into the staff of the Supreme Court to the Head of the Supreme Court.

Within three days following acceptance of the respective requests, the Head of the Supreme Court shall enroll the judges into the staff of the Supreme Court in the cassation court of the jurisdiction equivalent to the jurisdiction of the judicial chamber of the Supreme Court of Ukraine where the judges have been administering justice.

5. In fulfillment of the provisions of paragraph 71 of Part XII “Final and transitional provisions” of the Law of Ukraine “On the judicial system and the status of the judges”, the High Qualifications Commission of Judges of Ukraine shall complete the relevant assessment within six months following the effective date of the Law, and if the latter is incompetent, within six months following establishment of the competent Commission.

6. For three months, putin’s armed aggression against free Ukraine has continued, resulting in thousands of military and civilian deaths, tens of thousands wounded, hundreds of destroyed cities, towns, civilian infrastructure, kindergartens, schools and hospitals. Millions of refugees. Ukraine and its people prove their devotion to European standards to the world community at the cost of their own lives. Through the heroic struggle for every piece of their native land, the Ukrainian people prove that independence, freedom and national dignity are their highest values. Ukraine, which was not allowed into the European Union or NATO, accused of propensity for corruption, which was predicted to take over russia for several days, stopped the aggressor on its own and with its heroic struggle proved Ukrainians’ full compliance with European values and Euro-Atlantic standards. . At the cost of thousands of lives of their best sons and daughters, the Ukrainian people have stopped the spread of the russian plague in Europe.
Our country needs help now. We are grateful to the world community for the humanitarian cargo and weapons provided. But it is equally important to combine international efforts to promptly investigate russian war crimes and acts of genocide in order to bring the perpetrators to justice in a timely manner.

On September 21, 2017, the United Nations Security Council unanimously passed Resolution 2379 mandating the establishment of an Investigative Team to collect and preserve evidence for use in national courts of international crimes carried out by the terrorist group Islamic State in Iraq and the Levant (ISIL). Resolution 2379 marks a growing trend in the United Nations’ establishment of investigative mechanisms to support the domestic prosecution of international crimes.
Resolution 2379 arises from ISIL’s armed activities in the territory of Iraq. Beginning in 2003, ISIL’s predecessor, Al-Qaeda in Iraq, launched terrorist attacks with the goal of seizing control of Sunni-majority areas of Iraq. Following the outbreak of armed conflict in Syria, the organization sought to incorporate territory in Syria and Iraq into a purportedly sovereign entity called the “Islamic State in Iraq and the Levant.”
In its Resolution 2249 (2015), the UN Security Council found that ISIL “constitutes a global and unprecedented threat to international peace and security.” In addition to its terrorist attacks around the world, ISIL imposed a repressive regime over the territory it controlled, reportedly engaging in widespread and systematic violations of international human rights and humanitarian law.
The resolution requests that the Secretary-General establish “an Investigative Team, headed by a Special Advisor” to support domestic efforts to hold ISIL accountable by collecting, preserving, and storing evidence in the Republic of Iraq of acts that may constitute war crimes, crimes against humanity, or genocide. Resolution 2379 and the Terms of Reference contemplate that evidence collected by the Investigative Team may also be used in “criminal proceedings conducted by competent domestic courts and in third States.”
Please adopt a resolution on the establishment of an investigative group to collect and record evidence of war crimes by the Russian Federation in Ukraine.

В місті Порто (Португалія) 28-30 квітня 2022 року відбувся черговий З’їзд Європейської асоціації суддів.
На З’їзді наш волонтер Коротун Микола Вадимович презентував доповідь і звернення свого батька Президента Асоціації суддів України Коротуна Вадима Михайловича до делегатів З’їду. Зала аплодувала стоячи!!! Після виступу, майже, одноголосно було прийнято Резолюцію.

Despite the aggressor’s temporary seizure of part of Ukraine’s territory, the national judicial system continues to function fully under martial law. Unfortunately, several courtrooms were destroyed or damaged, several court staff were killed and injured, and many judges and court staff lost their homes. The President of the Supreme Court promptly decides both on the temporary change of territorial jurisdiction and on the resumption of the work of the courts in the territories liberated from russian. A significant number of judicial employees on their own initiative serve in the Armed Forces of Ukraine, voluntary military formations, engaged in public volunteer work. Judges decided to voluntarily transfer part of the salary to the Armed Forces of Ukraine during martial law.
Of course, Ukraine is going through difficult times. But we are confident in our victory. We will rebuild destroyed cities and villages, kindergartens, schools, hospitals. We will rebuild our economy. Our country needs help now. We are grateful to the world community for the humanitarian cargo and weapons provided. But it is equally important to combine international efforts to promptly investigate russian war crimes and acts of genocide in order to bring the perpetrators to justice in a timely manner. Another important area is the identification of assets of russia and its citizens, which are subject to international sanctions, as well as the development of effective mechanisms for their implementation. Judges of Ukraine appeal to their European counterparts to assist in the following:
– Ukraine will be admitted to the EU as soon as possible
– The soonest recovery of its economy
– Prompt consideration of court cases related to the consequences of armed aggression in Ukraine.
